1. Acceptance of Terms

By accessing or using ViralTake ("the Service"), you agree to be bound by these Terms. If you disagree with any part of the terms, you must discontinue use of the Service immediately.

2. Social Media Risks & Liability

You acknowledge that the Service interacts with third-party platforms (including but not limited to YouTube, TikTok, Instagram, Facebook, and Threads). You explicitly agree that:

• You are solely responsible for ensuring your use of the Service complies with the Terms of Service of these third-party platforms.
• We are NOT RESPONSIBLE for any account bans, suspensions, "shadowbans," copyright strikes, or content removal that may occur as a result of using our Service.
• We make no guarantees regarding "virality," view counts, or monetization eligibility.

3. User Representations & Warranties

You represent and warrant that:

• You own or have the necessary licenses, rights, consents, and permissions to use and authorize us to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all User Content to enable inclusion and use of the User Content in the manner contemplated by the Service and these Terms.
• Your User Content will not defame any third party or infringe upon the rights of any third party.

4. Prohibited Content

You agree not to upload content that is illegal, hateful, violent, pornographic, or infringes on intellectual property rights. We reserve the strict right to terminate your account and wipe your data without prior notice if we determine, in our sole discretion, that you have violated this provision.

5. Indemnification

You agree to defend, indemnify and hold harmless ViralTake, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of the Service.

6. Limitation of Liability

IN NO EVENT SHALL VIRALTAKE BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, OR ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN.

7. AI & Automation

The Service utilizes Artificial Intelligence (AI) technologies (including OpenAI, Anthropic, Google Gemini, and others). You acknowledge that AI outputs can be unpredictable and may contain errors. You agree to review all generated content before publishing. We claim no ownership over the *original* content you provide, but we claim rights to the *improvements and metadata* generated by our system as described in the Rights Grant section.
